AKERS TERMS OF SERVICE

OVERVIEW
Welcome to AKERS. “We,” “us,” and “our” refer to AKERS. These Terms of Service (the “Terms”) govern your access to and use of our website, content, features, tools, products, and services (the “Services”). Our store is hosted by Shopify. By using the Services, you agree to these Terms and Shopify's Privacy Policy. If you do not agree, do not use the Services. 

1. ACCESS AND ACCOUNT
You must be the age of majority in your jurisdiction. You are responsible for account credentials and all activity under your account. Information you provide must be accurate and current. We may suspend or terminate access for any breach. 

2. OUR PRODUCTS (ONE-OF-A-KIND NOTICE)
Colors and appearance may vary by device. Product descriptions and availability may change without notice. Many AKERS jackets are one-of-a-kind or produced in very limited quantities; availability is not guaranteed and cannot be reserved without order acceptance. We may discontinue or limit quantities to any person, region, or jurisdiction. 

3. ORDERS; ACCEPTANCE; NON-RESELLER USE

Your order is an offer to buy; we may accept or decline at our discretion. We generally accept only after successful payment authorization. We may cancel or limit any order (including suspected resales, exports, or fraud) and will attempt to notify you using the contact details provided. Purchases are for personal/household use only and not for resale. Your purchases are subject to our Return & Refund Policy, incorporated herein by reference. 

4. PRICES; BILLING

Prices (in USD unless stated) may change without notice. Posted prices exclude taxes, duties, shipping, and handling unless stated. You authorize charges to your selected payment method for the order total. You agree to keep payment and contact details current. We may correct errors (including pricing and availability) and cancel orders arising from such errors. 

5. SHIPPING; TITLE; RISK OF LOSS; DELIVERY
Shipping options, timing, and fees appear at checkout. Title and risk of loss transfer when we deliver goods to the carrier. We are not liable for carrier delays, customs processing, or events outside our control. International customers are responsible for duties and taxes. 

6. INTELLECTUAL PROPERTY
The Services and all related content, designs, images, text, logos, product designs, and code are owned by or licensed to AKERS and protected by law. You may use the Services for personal, non-commercial purposes. No rights are granted except as necessary to access and use the Services. Trademarks and trade dress may not be used without prior written permission. 

7. OPTIONAL TOOLS; THIRD-PARTY LINKS
We may provide access to third-party tools and link to third-party sites. These are provided “as is” without warranties. We are not responsible for third-party content, policies, or practices. Use at your own risk and review third-party terms. 

8. RELATIONSHIP WITH SHOPIFY
Our store is hosted by Shopify. Sales are solely between you and AKERS; Shopify is not responsible for your purchases. You release Shopify from claims arising out of transactions with AKERS. 

9. PRIVACY; DATA SHARING WITH SHOPIFY
Your use of the Services is also governed by the AKERS Privacy Policy and applicable Shopify privacy disclosures; certain personal information is processed by Shopify to operate the Services, including cross-border processing. See Shopify's Privacy Policy for details. 

10. FEEDBACK AND USER CONTENT
By submitting reviews, feedback, or other content (“Feedback”), you grant AKERS a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, adapt, publish, and display such Feedback in any media for any lawful purpose. You represent you have all rights in such Feedback and that it complies with law and these Terms. We may monitor, edit, or remove unlawful or objectionable content.

11. ERRORS, INACCURACIES, AND OMISSIONS
We may correct errors or update information (including pricing, availability, shipping charges, and transit times) and cancel orders if information is inaccurate at any time, including after you submit an order. 

12. PROHIBITED USES
No unlawful, infringing, harmful, deceptive, or disruptive use. No scraping, crawling, spamming, or interference with security features. No upload of malware or content you lack rights to. We may suspend or terminate for prohibited use.

13. TERMINATION
We may terminate or suspend access at any time. Sections that by nature should survive termination do so, including IP, Feedback, Disclaimers, Liability Limits, Indemnity, Governing Law/Disputes, and Miscellaneous.

14. DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers. 

15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, AKERS and its officers, directors, employees, agents, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, or data, arising from or related to the Services or products, even if advised of the possibility. Our aggregate liability will not exceed the amount you paid for the product(s) giving rise to the claim. 

16. INDEMNIFICATION
You agree to indemnify and hold AKERS harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, infringement of third-party rights, or misuse of the Services.

17. GOVERNING LAW; VENUE
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in Fulton County, Georgia.

18. MISCELLANEOUS
Severability: unenforceable terms are modified to the minimum extent necessary; the remainder remains in effect. No waiver by AKERS of any term is a waiver of later breaches. Assignment: you may not assign without our consent; we may assign without consent. Headings are for convenience only. These Terms, plus policies referenced here (including Return & Refund Policy and Privacy Policy), are the entire agreement.  We may update these Terms at any time by posting a revised version on this page. The revised Terms are effective on the date posted unless a later effective date is otherwise stated. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
